Arvind Kejriwal, Delhi's Chief Minister, has been arrested. "In the scam, Delhi's CM Arvind Kejriwal has been arrested by the ED." The ED has called him a kingpin and a key conspirator in Delhi's liquor scam. This is a big deal because Arvind Kejriwal has become the first sitting CM in Independent India who has been jailed. On one hand, people are saying that the BJP government is ending democracy by putting opposition leaders in jail, even a few weeks before the Lok Sabha elections. Rahul Gandh
i said about PM Modi that a scared dictator wants to destroy democracy. It's a different story that Rahul Gandhi's party wrote a letter to Delhi police in March 2022 that the AAP's liquor policy is corrupt. Raghav Chadha, a member of AAP, said that India is in an undeclared emergency and our democracy is in danger. After Arvind Kejriwal's arrest, his party workers started protesting in Delhi. Because of this, Section 144 was imposed in many parts of Delhi. On the other hand, supporters of the go
vernment say that the AAP and the opposition keep crying. Why don't they let CBI and ED do their job? This is a major problem in today's polarized society. Both sides keep throwing mud at each other but don't want to know about the issue. This is what I want to change in this video. What is the liquor scam about? What allegations has ED made against Arvind Kejriwal? And to what extent is this allegation true? Because until we understand the case, debating is useless. So this is a detailed video
on the Delhi liquor scam. To understand this, you need to understand how liquor is sold in our country. To make this video, we had to read many documents, including legal documents shared by CBI and ED. And you can see that it's not easy to understand these documents. To increase our efficiency, we used ChatGPT 4, which is paid. You can upload PDF documents there and ask questions about the meaning of the PDF document. We use this tool to verify our analysis. You can also use AI and ChatGPT to b
e efficient in your work. For this, I recommend a 3-hour paid workshop on AI and ChatGPT, which is free for you. The link is in the description. This workshop is paid, but it's free for 1000 people. Here, you'll learn about prompting and AI, which very few people know about. So whether you're in tech, non-tech, HR, finance, freelancer, or a founder, you'll get to learn. More than 10 lakh people have taken this workshop. Here, you can learn how you can find jobs with the help of AI, understand th
e complex data of Excel, make videos and ads ideas in a few minutes, and do a lot of work for your business. It's a good opportunity to learn because the workshop is free. The link is in the description. But remember, it's only for 1000 people. This is a common liquor shop in Delhi. Many people call it a Theka. It's a shady shop where many people don't want to buy anything. Manish Sisodia talked about this shop in 2021, when he said that such shops have a bad environment, and the customer is not
treated with respect. He wanted to change this. Manish Sisodia said that there won't be such shops in Delhi. Instead, there will be spacious, well-lit, and air-conditioned shops. Many of you may ask, why does the minister who changed the image of Delhi schools, want to improve the alcohol shops? To answer this, you need to understand why our state governments love alcohol so much. Any state government can make money in two ways. Own revenue or transfers from the centre. Own revenue includes the
money collected by the state government from its tax sources. For example, state GST, VAT on petrol or diesel, alcohol excise duty and non-tax sources like licenses, or profits from government companies. There are two things in transfers from the centre. One is when the central government helps the state government in some way. And the other is the share of the state on the centre's taxes. The share of every state is given in the 15th Finance Commission. So, in summary, every state government m
akes money from its own revenue and from the transfers from the centre. Every state government wants to reduce its dependence on transfers from the centre and increase its own revenue. Because if tomorrow the central government changes the transfer formula, then it will be affected. As Manish Sisodia said in 2021, the Delhi government gives Rs.1,20,000 crores to the central pool in direct taxes, but they only get Rs. 325 crores back. So, many states are fed up with this and want to make money th
emselves, which they'll keep 100% in their state. And to make money for themselves, alcohol revenue is very important for many states. For example, 22.9% of Karnataka's own revenue comes from the excise duty of alcohol, whereas this number is 19.9% for Delhi. Now, a state can increase its tax revenue by increasing corporate tax or land revenue. But no factory will be set up in a month. Many reforms are needed to increase corporate tax or land revenue, and it takes years. A quick way to increase
your tax revenue is by increasing your tax on diesel, petrol, or alcohol. Why not on other items? Because other items fall under the category of GST. And not a single state decides the GST rate. All states decide with the central government. And why doesn't the state government increase taxes on diesel and petrol? Because if taxes are increased on them, it becomes an election issue. The only option left for many states is to increase their tax revenue by selling alcohol. Yogi Adityanath's UP gov
ernment has been doing it for a long time. It has implemented a new alcohol policy which has made their alcohol revenue increase by 3 times from 14,000 crores to 41,250 crores in just 3 years. Every state has full freedom to decide its alcohol policy. And they can even set up their tax rate on alcohol. Karnataka has the highest tax rate in the country. The International Spirits and Wine Association of India has analyzed the situation and found that the bottle sold in Goa for Rs.100 is sold in Ka
rnataka for Rs.513. Usually, when you increase taxes on an item, the demand for it decreases. But that doesn't happen with alcohol. M. Govinda Rao, a member of the 14th Finance Commission, said that state governments can increase taxes on alcohol because consumers are so desperate that even if the prices go up, they'll still buy it, which increases the state government's revenue. But for this, a state government has to do two things. 1. Stop illegal liquor distribution and 2. Design Vend Auction
s Better. Designing Vend Auctions Better is an important term which you'll understand in a while. Keep watching the video. This is what the AAP wanted to do in Delhi. They wanted to increase their revenue from alcohol. The AAP said in 2020 that the Delhi excise policy was decided by Congress and had three problems. 1. The customer experience is bad. If the customer experience is bad, they won't buy which decreases the revenue. 2. The alcohol shops in Delhi can't compete with the shops in Haryana
. The Delhi consumer isn't buying in Delhi but in Gurugram or Noida. 3. There's a liquor mafia in Delhi that's doing corruption which decreases the government's revenue. Let's investigate these three problems one by one. The AAP said that the customer experience is bad because most of the shops are run by the government. There were 630 liquor shops in Delhi and 60% of them were run by the government. There are four main players in the alcohol business. 1. Manufacturers who make alcohol. 2. Distr
ibutors or wholesalers who supply alcohol to different areas. 3. Retailers who finally sell alcohol to the consumer. 4. The consumer, who buys it. In Delhi, the government had full control over wholesale and 60% control over retail outlets. These retail outlets were run by the government's four bodies. A Delhi government report said that there's a crowd outside the shops that's desperate for alcohol. The government said that because of the crowd, many women don't even go near the shops. Ankita K
umar, who works for an event management company, said in Hindustan Times that the environment outside the shops is masculine and unsafe. A Delhi government official said that there are smaller shops around the shops that sell snacks, plastic glasses, cigarettes, and cold drinks which creates a crowd and makes the environment unsafe for women. The party said that they want to change this. The only way is to stop the government from selling alcohol and ask private companies to sell it. The second
problem that the Delhi government raised is that their customers don't buy alcohol from Delhi but from Uttar Pradesh or Haryana. They said that there's a drinking age of 21 in Uttar Pradesh and recently, Haryana also changed it to 21. So they need to reduce their drinking age to compete. Another problem is that the retailers in Haryana can offer discounts to their customers. There was a law in Delhi that retailers were to sell alcohol at a fixed price. So many customers went to Haryana to buy be
cause they were getting a discount. The third problem was corruption. The Delhi government said that there's a setting between a manufacturer, distributor, and retailer. Because of this setting, the retailer wants to sell only a few branded bottles. The Delhi government accused the retailers of 'brand-pushing.' They want to sell only the branded bottles that give them a high commission. The government also said that many retailers aren't paying taxes. They were lying to the government about how
many bottles they were selling so that they don't have to pay taxes. The government filed cases. But this didn't help. The Aam Aadmi Party said that many of the retailers were smuggling bottles from Haryana and UP and didn't pay any tax on the bottles. They said that to save this tax, many shops didn't even give receipts to the customers. Now you understand all the problems. But the Delhi government said that in 2021, they'll introduce a new excise policy on alcohol. Arvind Kejriwal said that th
ey're going to destroy the liquor mafia just like they destroyed the water, electricity, and health sector mafia. In February 2021, Chief Minister Kejriwal formed a committee of a group of ministers to design this policy. The committee's head was Manish Sisodia along with Health and Industry Minister Satyendra Jain and Transport Minister Kailash Gahlot. In June 2021, the new excise policy was released. The Aam Aadmi Party said that all the old problems will be solved. How? The customer experienc
e was bad because the government was running the shops. That won't happen because they'll sell licenses for the entry of private players. So they designed an auction system so that there's equal distribution of liquor stores in the city. So Delhi was divided into 32 zones and licenses for each zone were sold. It was said that there could be 27 retail shops in each zone. 32 x 27 is 864*. So there will be 864* liquor shops in Delhi. And the Delhi government will earn money by selling the licenses
of these shops. Any government can earn money by selling alcohol in three ways. The first way is by selling the licenses of wholesalers or retailers. The second way is through excise duties which are given by the liquor manufacturers on the bottles of each liquor that leave their factories. And the third way is value-added tax or VAT which is given by the consumers when they buy alcohol. Remember, alcohol doesn't require GST. It requires VAT so that each state can decide its own tax rate. The De
lhi government argued that they'll earn money through all three ways. If private players enter the market they'll earn money through license fees and through VAT and excise duties because customers will get better service. Earlier, there were only 630 shops. Now there will be 864* shops in Delhi. All of them are privately owned. The auction system of these licenses is similar to the bidding system in IPL. A minimum price is set and the company that pays the most gets the license. The Delhi gover
nment set a starting price of Rs. 221 crore for each zonal license. A company that wins a zonal license can start 27 retail shops in that zone. These retail shops also had certain conditions. Their area should be at least 500 sq. There should be air-conditioning and good lighting so that the customers get a good experience. In addition, the Delhi government said that in the entire city 5 super premium retail shops will open. These stores will be 5 times bigger i.e. at least 2500 sq. These shops
will have a tasting area where consumers can try different types of alcohol. Apart from this, these stores can sell cigars, liquor chocolates and high-end art paintings. The Delhi government said that such premium stores are doing well in Hyderabad and Bengaluru, they should open in Delhi as well. And many consumers were excited. For example, the 24-year-old fashion designer Deepali Agarwal said that she wants to celebrate the big occasions of her life whether it's graduation or a wedding by buy
ing expensive alcohol. The Delhi government also made some other changes. The drinking age used to be 25, but now it's 21. Bars and restaurants can be open till 3 in the night. The number of dry days used to be 25 but was reduced to 3. Home delivery was also started with some selected retailers. They said that whether it's Karnataka, Kerala or Pune, Calcutta, alcohol is being delivered at home, so why not start it ourselves? For security measures, they said that no shop windows should face the r
oad and customers should not be crowded outside the shop and all customers should be inside. And there should not be any small shops around the alcohol shop selling snacks or cigarettes which might attract a crowd. Every shop should have CCTV cameras installed inside and outside the shop. And if they get a complaint from the neighbourhood, the shop's license will be cancelled. The Delhi government said we solved the problem of bad customer experience. Now let's see how to fight Haryana and Uttar
Pradesh. Earlier, retailers could sell at a fixed price but the Delhi government said that now retail shops can give a discount of up to 25%. To compete with the Gurugram shops, many Delhi retailers printed posters and gave a 25% discount. To ensure that there's no monopoly in the business, the government said that no company can bid for more than two zones. They also said that no retailer should be involved in the business of wholesalers and manufacturers because if the same company is involve
d in different supply chains, then the prices for the customers will increase. The same thing happened in Uttar Pradesh during the Mayawati era where Ponti Chaddha was in full control of the entire liquor supply chain. Many consumers had to spend more than MRP to buy a bottle. This extra money was called Mayaprasad. The government said that to avoid this, manufacturers, distributors, and retailers should be different. Earlier, retailers used to evade taxes and didn't tell the government how many
total bottles they sold. This time, the Delhi government said that they would collect the tax and fees first. So when you're paying a license fee, you'll have to pay the tax along with the license fee. This way, no one will be able to avoid taxes. As for the issue of alcohol, which was illegally brought from another state, the government said that labels will be placed on the bottles with high-security features. Then the officials of the Excise Department will be asked to use the Checko app dev
eloped by the IIT Kanpur team. They will scan the label with this app to find out if necessary fees have been paid for the bottle. Some of you may say that this sounds logical. Why did Arvind Kejriwal and Manish Sisodia go to jail? This is good news. Wait a little and you'll understand where the bad news came from. As soon as this new policy was announced, many people were happy. Especially restaurant owners, bar owners, and those involved in the alcohol trade. Inderpreet Singh, who owns an alco
hol store at the Galleria Mall in Mayur Vihar, said that earlier, the youth of Delhi used to drink in UP or Haryana. But now, the government will earn the money. Many government officials praised the policy. A former Excise Commissioner said that since the government has allowed wholesalers and retailers to offer discounts, the government will benefit. The policy was executed in August 2021, and the AAP announced that the policy was a hit. A total of 32 licenses were to be sold. But the governme
nt earned Rs. 5,300 crores from 20 licenses. They said that within a year, they'll earn Rs. 10,000 crores from this policy. Whereas in the last 3 years, the average revenue from the Excise policy was only Rs. 5,600 crores. This means that the revenue was increasing by more than 60%. The starting price of each zone was Rs. 221 crores. But on average, the license was sold at Rs. 265 crores. The highest license fee was for Zone 31 or New Delhi Zone where Delhi has many posh colonies. This license p
rice was sold for Rs. 315 crores. An official from the Delhi government said that the Excise policy was an all-round smashing success. Vinod Giri, the Director General of the Confederation of Indian Alcoholic Beverages said that bidders didn't just come from Delhi, but also from other cities like Hyderabad and Bangalore who won the auction. He said that these people will bring their experience to Delhi which will benefit the customers. But Vinod Giri didn't know that because of some of these peo
ple, Delhi's Chief Minister was going to go to jail soon. Who were these people? You'll get to know it in a while. The AAP said that the policy was a super hit. On the other hand, many people opposed it. The BJP started this protest. The President of the BJP's Delhi Unit, Adesh Gupta, said that it would be right for the government to control the liquor policy so that our youngsters and women are safe. Why did they reduce the drinking age? This is a political hypocrisy. A few months later, the BJ
P government in Haryana also reduced the drinking age. Many citizens started protesting. For example, the residents of Badarpur village in Delhi said that the government is opening liquor shops in our area when they should be giving us clean water. Many residents of Delhi raised their voices against the opening of liquor shops near their homes. The BJP and Congress Party protested that the government is opening shops in schools, religious places, and other unauthorized areas. The owner of a liqu
or warehouse said that because there's a minimum requirement of 500 square feet to open these shops, it's difficult to find such places. It's difficult to find such a huge space anyway and moreover, the residents of welfare associations also said not to open liquor shops in certain areas. Many business owners were fed up. After this policy, 134 legal cases were filed against the government. Mostly, these cases were about liquor shops being opened in the wrong areas. For example, residents of Jan
kpura filed a case against the Delhi government in the Delhi High Court for opening a liquor shop near a school and a hospital. This is when problems get more serious for AAP. Many people start saying that this policy favours big businesses and not small businesses. They give many examples. For bidding on the tender documents, you had to pay a non-refundable fee of ₹10 lakh and an honest money deposit of ₹30 crore for one zone. And if someone bids for more than two zones, then this deposit was ₹
60 crores. An honest money deposit or EMD is used in the tender to check whether a company is serious about bidding or not. And if a company usually loses a bid, then this EMD is refunded to them. The point about EMD is very important because this is why Manish Sisodia is in jail. Companies used to say that EMDs used to be of ₹8 lakh but in this new policy, EMDs are ₹30 crore. Only big businesses can bid on this. Whereas, Delhi government officials said that they want people to enter the market
who can provide a premium experience to their customers. This is why we have set such rules. This was the first problem. The second problem was that all these retail shops should have a minimum of 500 square feet. Many businesses said that only big businesses can afford such a large area for rent. How will we afford it? The third problem was that the sizes of the zones were also large. Like Vinod Giri said large sizes will increase the bid and small players won't be able to participate in the au
ctions. The fourth problem was that companies had to pay taxes with the license fee. So companies said that only those people can pre-pay taxes who have a good amount of money. So again, big businesses were favoured. The fifth problem was that a war broke out between Delhi and Gurugram. The Price War. "Delhi's retailers printed posters and distributed them to show why to go to Gurugram." "You'll get cheap liquor in Delhi." Because this policy allowed retailers and wholesalers to give discounts,
many retailers printed posters asking why go to Gurugram. They shared discounts on WhatsApp with their customers and started buy-one-get-one-free deals. This led to huge queues outside Delhi's retail shops. But the rules were different in Gurugram. You could give discounts to your customers but you couldn't market them. The government also set a minimum price that no retailer could go below. So the shops in Gurugram were struggling in this price war. But don't think that Delhi's shops were doing
well. Bheem Singh, who runs a liquor shop in Hero Honda Chowk, Delhi, said that the price war made it difficult to make a profit. And because of the market, he had to give maximum discounts to his customers. Many retailers were saying that they were already prepaying taxes and now a price war had started. This led to many retailers leaving their businesses and returning the government's license. 9 out of 32 zones in Delhi were empty. The government's plan was to open 864* shops. By May 2022, on
ly 639 shops and by July 2022, only 464 shops were left. This led to the loss of crores of rupees by the Delhi government. But the Aam Aadmi Party said that this loss wasn't due to them. It was due to the LG of Delhi. Former LG Anil Bajaj, which was installed by the Modi government. Manish Sisodia said that the excise policy clearly stated that 864* shops would be opened in Delhi, including many in unauthorized colonies. He said that LG agreed to this. After which, the file was sent back for fin
al approval. This policy was to be implemented on 17th November. But just two days ago, LG said that if these shops were to be opened in unauthorized colonies, then you'd have to get permission from the DDA and MCD. Because of which, these shops were not opened. And Manish Sisodia said that this loss was because LG didn't allow these shops to open. Manish Sisodia didn't answer why so many people returned their licenses. And LG didn't answer why he removed the approval just two days ago. While th
e policy was being planned, a report by the Delhi government stated that customers are treated like criminals in today's liquor shops in Delhi. And the Delhi government wants to change this. But maybe the Aam Aadmi Party didn't know that in a short span of time, their ministers would be treated like criminals. On July 22, Delhi's Chief Secretary Naresh Kumar submitted a report to LG BK Saxena where he said that there were some irregularities in the excise policy. The LG read the report and asked
for a CBI investigation. In his report, Chief Secretary Naresh Kumar filed three allegations against the government's excise department. And the head of this department was Manish Sisodia. The first allegation was that several changes were made to the policy which reduced the government's revenue. And he gave several examples of this. For example, the government returned a license fee of Rs. 145 crore to some companies on the pretext of COVID-19. Then the government refunded a company's Rs. 30
crore earnest money deposit when they didn't get the No Objection Certificate or NOC from the airport authority where they had to set up their retail shop. The chief secretary said that if the company didn't get the NOC, then it was the company's fault. Why did you return the deposit? The excise department also reduced the prices of foreign liquor. And they also reduced the import pass fee of Rs. 50 on the case of beer. This reduced the prices of beer and foreign liquor and reduced the governmen
t's revenue. The second allegation was that the Excise Department created a cartel. A cartel is created when several companies work together and there's no competition in the market. This is a loss for the consumer because the prices increase. The government's policy had certain rules to prevent the creation of a cartel. The same company cannot be a manufacturer, wholesaler, and retailer. But the chief secretary said that this policy wasn't executed properly. And many companies got licenses that
were working together secretly. The third allegation was that the excise department made several changes to the policy without the approval of the LG and the Cabinet. And it was stated in the report that the AAP did this so that they could get money from some companies which they would use to fight in the elections in Punjab. After reading this report, LG Saxena wrote a letter to the Home Ministry and said that there should be a CBI investigation on the Delhi excise department. Arvind Kejriwal
replied that this investigation won't get you anything. He said that he had known Manish Sisodia for 22 years and he had never met anyone more honest and patriotic than him. The truth wasn't clear. But one thing was clear that this new excise policy wasn't so successful. In the first quarter, the excise revenue of the government was 37% less than expected. That's why, a few days later, on 31st July, 2022, AAP announced that it was withdrawing the new excise policy and the old policy would start
again. That is, the government shops would sell alcohol again in Delhi. Let's first understand the timeline and then we'll discuss the charges imposed on Arvind Kejriwal and Manish Sisodia. I have used several documents for this, the link is in the description. For example, Manish Sisodia's case discussed in the Delhi District Court, the press release of the ED, and Manish Sisodia's case discussed in the Supreme Court. This policy was withdrawn on 31st July, 2022. And 17 days later, the CBI file
d an FIR which had the names of 15 people. Manish Sisodia was there on the list, and many government officials of the excise department were also there. Two days later, the CBI raided 31 locations which were related to Manish Sisodia, including his home. A few months later, his bank locker at the Punjab National Bank was also examined. But Manish Sisodia said that the CBI got only ₹80,000 from his locker and that he had given him a clean chit. But at the same time, rumours started that the Enfor
cement Directorate, or ED, would also be involved in this investigation. Because this is a case of financial irregularity. The ED started the investigation under the Prevention Against Money Laundering Act, or PMLA. Remember this PMLA because it will play an important role. Both the CBI and the ED are working on this case and things get serious for the AAP. Between September 2022 and February 2023, many people are arrested. The first to be arrested is Vijay Nair. Vijay Nair was once the CEO of a
n event management company known as Only Much Louder or OML. Many comedy channels, be it EIC or AIB, were successful because of him. Vijay Nair joined the party in 2014 and was ultimately made the communication in-charge of the party. So, be it the Punjab or Gujarat elections, he was handling the party's communications. While the CBI arrested Vijay Nair, the ED arrested many people who worked in the liquor industry. Like Sameer Mahendru, Butchi Babu, and Abhishek Boinpally. But this case becomes
politically serious when K Kavitha, who is the daughter of KCR, is named in ED's chargesheet. The ED calls these people the South Group. The AAP was shocked on February 26, 2023. "The CBI has made the biggest arrest in Delhi's liquor scam." "The CBI has arrested Delhi's Deputy CM, Manish Sisodia." Many AAP workers protest. This is a big shock for the party because Manish Sisodia is so important for the party. Manish Sisodia handles 18 portfolios of the Delhi government's 33 portfolios includin
g education, health, and finance. Manish Sisodia is also very important for the party's campaigning. At that time, India was about to have several state elections. Manish Sisodia challenged his arrest in the Supreme Court. CJI Chandrachud says that if everyone comes to the Supreme Court like you, it will be a big problem for us. First of all, you go to the High Court. In the High Court, his bail was rejected. The High Court says that the charges against him are very serious. Apart from this, he
is a highly influential person because he is the Deputy Chief Minister. Because of this, if he gets out on bail, he can influence many witnesses. That's why his bail was rejected. When Manish Sisodia was in Tihar Jail due to the arrest of the CBI, the ED comes to him, questions him for 9 hours, and arrests him in a money laundering case. The ED says in its chargesheet that Manish Sisodia changed the excise policy in favour of the South Group. For this, he received Rs 100 crores from this group.
Now, Arvind Kejriwal is also called for many summons or questioning. Between October 2023 and February 2024, the ED sends 8 summons to Arvind Kejriwal and he does not comply with any of them. Arvind Kejriwal writes a letter to the ED where he says that the BJP government is using the ED to target them so that they don't campaign for Lok Sabha elections. On 17 March 2024, the ED sends the 9th summon to Arvind Kejriwal and two days later, it says that Mr. Kejriwal was a chief conspirator in this l
iquor scam. Arvind Kejriwal learns that the ED will arrest him so he goes to the Delhi High Court for preventive action so that he is not arrested. The High Court says that Arvind Kejriwal should not worry because usually, cases like this don't involve arrests. Go to the ED so that you can find out what the case is about. The next day, the ED decides that this is the perfect moment to strike. With the 10th summon, they reach the Chief Minister's house. Many AAP leaders and workers surround his h
ouse and they are not allowed to enter. "Even the people from the media couldn't go there because of the police." "Do you think people like us can go?" There's a heavy deployment of the police and tension rises. Section 144 is imposed so that more than 4 people cannot gather. In a short while, the supporters of the AAP know that what they were afraid of is true. Arvind Kejriwal is arrested. The ED says that they have serious evidence to show that Arvind Kejriwal asked K Kavitha for ₹100 crores a
nd in return, she was given a favour in the excise policy. Now let's understand the charges that the CBI and the ED have imposed against the AAP leaders. To understand these charges, you can read the ED's remand application for Arvind Kejriwal on 21 March 2024. The main charge is that the AAP has taken ₹100 crores from several companies, which have been called the South Group. In return, they have given several policy favours to these companies. The ED says that the Delhi government gave a big f
avour by making a policy that will benefit the big businesses. The ED says that the AAP helped the South Group to form a cartel where they got the licences for wholesalers and retailers. The ED's chargesheet says that several cartels were formed in the Delhi liquor business. The ED says that the South Group got a wholesaler licence when their company Indo Spirits won an auction. And these people got a retail licence when a different company, Khao Gali, got retail licences for two zones. The CBI
says that there were several companies in this process, but the same people were working behind these companies. That was the South Group. They say that K Kavitha was not the owner of any company in the paper, but was being represented by Arun Ramchandra Pillai. The AAP was being represented by Vijay Nair in all these negotiations. The ED says that before the release of this policy, Vijay Nair had shared this policy with Arun Pillai and K Kavitha's CA on WhatsApp. The ED says that this was done
to favour the South Group, and Arvind Kejriwal knew about it. To provide evidence, they say that Arvind Kejriwal had spoken to Sameer Mahendru, who was a member of the South Group, on FaceTime. Arvind Kejriwal told him, Vijay is my boy. Sameer, you can trust him. There's also an allegation that AAP increased the Wholesaler fee from 5% to 12% so that the South Group's wholesalers could benefit. The Wholesaler Fee is a fee that the alcohol manufacturer gives to the wholesaler. The CBI says that th
is was a very important change, and it was done without any approval. The ED says that because of this change, the South Group was able to earn an additional Rs.338 crore within 10 months. To provide evidence, the ED used Manish Sisodia's former secretary, C Arvind's statement. He says that this policy change was not discussed in any official meeting. Instead, Manish Sisodia wrote this policy change in a paper and said that he should make a new policy based on it. This was done at the home of Ch
ief Minister Kejriwal. This statement was given by Manish Sisodia's former secretary to the ED. The ED claims that this is why Manish Sisodia and Arvind Kejriwal knew what they were doing. The ED's chargesheet also states that Arvind Kejriwal himself asked for Rs.100 crore. For example, this chargesheet states that on 16th March 2021, Magunta Reddy, a member of the South Group, came to meet Arvind Kejriwal. He said that K Kavitha is ready to give me Rs.100 crore. If you want to enter the liquor
business in Delhi, you'll have to talk to her. The ED said that Magunta Reddy went to meet K Kavitha. K Kavitha said that AAP is demanding Rs.100 crore. If you want to enter the business, you'll have to pay Rs.50 crore. Magunta Reddy then apparently told his son Raghav to prepare Rs.25 crore with the help of Vijay Nair. The ED then showed WhatsApp messages to prove that the money was sent through Hawala Networks and was used in Goa for election campaigning. Now, this argument was of CBI and ED.
Manish Sisodia said in court that the evidence of CBI and ED is based on other people's statements and these statements were taken under pressure. "Imagine that the son of the owner of a company worth Rs.25,000 crore you put him in jail for 6 months." "In April, he broke down." "In April, he gave his statement." "He said that ED is telling the truth and that he gave Rs.100 crore." He gave an example of Raghav Magunta who changed his statement within 10 months. The same argument was given by Sour
abh Bhardwaj of AAP. He said that ED had arrested P Sharachandra Reddy's son and after some time, that company gave electoral bonds to the BJP. Later, they became approvers in this case and got bail. "They were arrested on 10th November." "On 15th November, Aurobindo Pharma gives a bond of Rs.5 crore to the BJP and the BJP takes it." In October 2023, when the Supreme Court was hearing Manish Sisodia's bail hearing, they also asked the same question to ED. Justice Khanna said that you have to pro
ve how Manish Sisodia used the money. We know that it is difficult to establish this chain, but this is what you have to do. Now you must be thinking that if the Supreme Court's justice is asking the question to ED to prove whether Manish Sisodia was involved or not, then why is he in jail? He is in jail because he was charged under the Prevention of Money Laundering Act. In PMLA, it is almost impossible to get bail. And this is what is going to happen with Arvind Kejriwal. In our legal system,
it is said that you are innocent until proven guilty. Only the court can prove whether you are guilty or not. Before that, you are considered innocent. But in PMLA, it is the opposite. You are guilty until proven innocent. You have to prove that you didn't do anything or else you will be in jail. This is the problem with PMLA. In 2018, the Modi government brought changes to PMLA and it introduced two strict conditions for bail. The first condition is that you have to prove in court that you are
innocent. The second condition is that when you get bail, you have to prove that you didn't commit this crime. The Supreme Court immediately accepted these changes. They said that money laundering is a serious crime that can stop the economic and social growth of a country. When PMLA meets ED, it is a terrible combination for opposition leaders. Since 2014, when the Modi government came into power, 95% of ED's cases were against opposition leaders. A total of 121 cases were against political lea
ders. Out of which 115 were against opposition leaders. But when such leaders join BJP or their allies, these cases suddenly stop. This is what happened with the Sovindu Adhikari. In 2017, ED summoned him several times when he was with the Trinamool Congress. But when he joined the BJP, the case didn't progress much. This is what happened with Bhavana Gawali, Ashok Chavan, Chhagan Gujbal, Pratap Sarnaik, and many other leaders. Now you've understood the arguments of both sides. I don't know much
more. We'll get more information in the next hearing. But now you can play the role of a well-informed citizen. Ask the Congress why they're supporting the AAP when they wrote a letter against the AAP's policy in 2022. Ask the AAP why it made so many changes to its policy, which benefitted big businesses. Ask the BJP government why 95% of ED cases are against the opposition. And when these people join your party, the cases stop. And if you get the chance, ask the Supreme Court what's so special
about PMLA that people don't get bail. Because remember, Delhi's people have suffered the most from this issue. Their government is stuck on legal cases instead of working. So you have to raise your voice. I did my job. Now it's your turn. @Abeyfranc

The entire media should be ashamed to call them journalists after watching the research on this video. Hats off Mohak.

@ami1498

If losing revenue in liquor business is a scam, then the entire Gujarat government can be jailed for the same.

@jamesnewme1073

ED and CBI should be under the Supreme court they should be free form any political party 😢😢😢

@Justanotheruser_04

What an excellent presentation of facts mohak. Just adding a few points here : 1. Money laundering is a serious crime and strict action has to be taken. 2. BJP should answer as to why 95% cases are against opposition and when they come into their party cases are not pursued. 3. If AAP hasn't done anything wrong, they need to co-operate with the investigation. Kejriwal was nly arrested after 9 summons. 4. We have to remember that BJP leaders were also treated the same way when they were in opposition but they always co-operated with the investigating agencies.

@ishigamiYo4733

BJP Minister brijbhushan singh should also be jailed...

@imgnryvansh

The irony is brijbhushan wasn't arrested after being accused of child abuse by India's gold medal holding wrestlers.

@sudhanshujoshi8025

CONGRESS - Fighting for their existence, AAP - Fighting to grow themselves, BJP - Just wanted to be a ruling party, no matter what steps they needed to take. The Supreme Court sometimes feels like it becomes a puppet of BJP Govt.

@jireh____

And the unfortunate reality is that BJP ministers are also doing the same thing , bending policies according to their needs

@jaijaijaijai123

only solution is: make CBI, ED and other agencies independent of any political interference.

@umangmankar6830

Bjp getting 6000 cr from many companies, and kejriwal is in the jail for 100 cr....😂😂

I've been following your channel since you had 60k subscribers and haven't missed a single video. This video, however, stands out as one of the best on politics—thank you for the information. Additionally, I appreciate that, unlike others, you don't impose your narrative on us; instead, you allow us the freedom to critically assess who is wrong and who is right, which I really admire. Thank you once more, Mohak Bhaiya.

For a Non-Delhi resident and a person who doesn't watch tv news, I understood this case very clearly. Explanation and visual editing were really good to understand.

@sagar18764

There is no good vs evil between our political parties. Its just a fight between a bigger evil and a smaller evil.
