efore you for a lean review the inspector that was on the case was Mike Fitzgerald in this case the uh respondent was first notified back in October of 2019 and order imposing F lean was entered July 9th 2020 for $100 per day responding came into compliance August 10th the Lan acred to $3,200 plus an additional 24 uh dollars for recording cost so the total amount of the lean right now is $3,224 the as you can see from your agenda the list of uh violations for uh plentiful the uh we had these are
a couple of meetings regarding this case the uh inspector reported that the respondent's position pretty much was he was using the money from tenants to pay for the repairs and the um and so he was in in compliance the um situation um from the perspective of the inspector was that it was not enough effort to accomplish what was necessary and so uh the request is that there be no reduction I will tnder um Mike fitzer the inspector so that he can speak further through the fact if you have any que
stions regarding the facts of the case any questions from Mr Fitzgerald uh the place is rented uh currently do you know the last I know that rent was the renters were still there where the place was rented okay okay what would you like to tell us well first of all uh you know thank you for allowing me to come here and discuss this and I think Mike Fitzgerald and and uh Mark Jones are wonderful and have done a great job my problem is first of all let me be very clear I did not depend on any rent
to have this work done and I sent a recap to the board we've got of the effort that I made in this past year I got a lot of assistance from the inspectors to help me with this the first time in March Mike fitzgeral came in and was able to get me an extension um due to the virus Etc but I the length of things that had to be done have totaled about 8 or ,000 bucks one of the problems was I had to have nine brand new windows installed in this house and when when Mike was able to get my first extens
ion um he knew that I asked them for an extra two months because the window company said oh they're going to be able to have it I didn't even get these windows in until almost June so I tried to communicate and I failed to let Mike know that I should have asked for four months instead of two months now I have done every single thing that they've asked for and because I had a multiple case going on at the same time Mark Jones was able to work with me and made a couple of trips to the the property
in which uh they couldn't even get into to look at stuff for one reason or another so I was dealing with contractors I was dealing with a a a uh a property management outfit and then I was dealing with contractors who use this this virus excuse that they couldn't get stuff done in time we know we're we're aware okay so I'm just asking for some lenience or removal of this I'll be glad to pay the court cost for it but I I just simply all right let let us discuss it uh the packet that was put toge
ther is pretty complete and Mr Harrington has some questions so go ahead uh on July 9th in our minutes it says you were doing the work as the renter paid that is absolutely not true that's a false statement in our minute that is a false statement in fact one of the rent persons that is renting besides the fact that they has a disabled child works for the city of Dayton so I'm not using somebody else's money I'm doing I'm paying for stuff myself bought this in 2015 what's that you bought this in
2015 this property yeah uh I've had it good gracious 10 years you've had it 10 years at least okay I'm looking at the quick claim lead that was dated to 2015 oh yeah have you been renting it ever since uh uh occasionally occasionally when I've been able to have someone one of one of let me explain something real quickly I have been paying apparently a business tax license unaware that there's a landlord's renters license there there is now not when you bought it okay well this was pointed out by
Mark Jones because I sent him a copy of my business license and he said look you have to have this whole new license license I made a trip to Daytona I applied for it and they said okay uh the next thing is I get the inspection done and they said oh you can't have a license I've read all of that in the thing I have some specific questions okay you've been how long you've been renting this on and off for 10 years well uh when I can it's uh you think that did you have a lease did you ever issue a
lease oh yes I've people have had leases I've had tenants that I've had to evi lease say who's responsible for keeping the M maintenance of the property uh I'm sure the lease I mean there's no active lease now you know you've had some some grief and I appreciate this is probably the most thorough report I've ever seen as to what your problem was what about the renters they live living with exterior walls dirt and grime fa failing paint exterior surfaces electrical outlets doors you've been rent
ing to people with this it hasn't always been like that okay how long do you think it's been like that probably since the the last people that just came in no no no this this report is from 102219 that was the report that was issued in October yeah so it's been at least October yeah uh okay prior to that I put a new roof on I put a brand new air conditioner in it a brand new hot water heater Plumbing was done but the items that about it being dirty and needed painting okay I had the place painte
d and then the electrical stuff apparently there's stuff were not in they needed fgi stuff put in but the tenants never said anything to me or asked me to do anything when you rent it to the tenants you signed a lease it must you must have surveyed the condition of the property and told them you know sign it Mr Harrington I I don't know at this point the property is in compliance or it is but we're not asking about whether it's in compliance clients were asking about a lean review for a hardship
and I'm concerned that there was more than one hardship there was a hardship for the tenant too uh so that you really were paying for these repairs out of the rent and uh you know I I just feel that that's a problem would you like to make a motion I would all right um looking at some of the facts that's been laid before us uh the uh owner says the tenants never said anything to him about it uh the owner says that our minutes were wrong uh and so my motion would be that we adhere to the city's r

ed for um we the city's asking for $100 per day up to $10,000 let's say you Mr scandin uh yes um uh I've been working on the house by myself okay and uh some of it the the roof in the garage is done painting on the front windows is done the fence is down I haven't gotten up to the higher parts of the house which I'm going to have to hire a handyman when I get the C when I enough C when I have the capital you do you have money to do this now not right I have it on the I get a check on the 23rd of
September and I have enough is this property occupied uh yes I live in it and my my grandchildren live with me just you and your grandchildren yes who's Louise what I'm sorry he's Joseph who's Louise oh Louise who's Louise their age no Louise scanland oh that's my mother okay she's deceased and my son he's the executive of the H of the okay the estate okay I have a question for the inspector go ahead uh uh when was the last time that you were out to this property September 3rd I believe uh the
last picture on the oh okay okay thank you so September 3rd you noticed there were no changes correct I got a question could you elaborate more on the violations because just looking at the house it doesn't look there's still uh excuse me there's still there's still some painting on some of the windows to be done yet before I call I call the I call the um Mr Robinson get his I was want to ask the code enforcement officer if he could elaborate more on what the violations are the violations were t
he accessory structure which is the damag fence protective treatments which is the peeling of the uh the painting of the walls exterior walls were damaged roof and drainage was damaged um the uh the that decorative features on the property needed to be repaired um an open window was the broken window right there in the front uh you can't see it through the uh the the close that broken window the overgrowth on the roof and on the on the drainage right there those are all violation okay plus there
was uh this this uh case was open through a search warrant on the property uh I have not been actually inside to see if the the extra bedroom that was in the back sun room has been removed yet I haven't been called for reinspection I haven't been in contact with the property owner um since the last hearing okay yes just to add that the the origins of this case started from a uh a community impact it was impacting the surrounding neighborhood because um he was allowing someone to live there that
wasn't allowing others to just occupy the home it it resulted in a lot of Narcotics use a lot of Narcotics problems occurring there as well as a lot of uh part one crimes mostly thefts uh and car breaks occurring in the burglaries occurring in this in the surrounding area as well and we that's part of why the search warrant was executed part and during that we recovered stolen property so it's come a long way it just hasn't got to where it needs to get is that that is a that I'm looking I'm sor
ry yes ma'am that first window next to the door is boarded up and the the one that has the metal shutter across the bottom uh Clos in the window that's also a bedroom and that can't be like that so are um are all Mr skan are all the people that caused the police problems gone from that house yes they are okay my daughter was uh my daughter was says yes okay good all right we have a motion to uh impose a fine of $100 a day up to $1,000 uh and can starting today and continue till compliance is ach

Helm cam I'm an Edward's daughter her daughter yes raise your right hand do you somly swear or affirm that the testimony that you're about to provide is the truth truth and nothing but the truth yes thank you okay Mr Jones good morning good morning Mark Jones Neighborhood Services my credentials are on file this case was open for a maintenance code violation and was supposed to be in compliance on April 3rd on July 21st we received contact that the property was going to be demolished on the uh 2
3rd of July the code board found the property in non-compliance with compliance to September 2nd as of today there's been no action taken no demo permit has been applied for and the condition Remains the Same staff is requesting a fine of $200 with a cap of 20,000 is this income property it's a commercial property commercial okay is it occupied no no it is not occupied okay all right uh what would you like to tell us well we've been trying to clean it out they told us they um we had to have it a
ll cleaned out before they could demolish it so we've been working on that um two weeks a little over two weeks ago my mother had an aneurysm and is in intensive Critical Care in Orlando um sorry we would just like to get an extension I'm sorry okay I have to tell you that at the date on here when you were someone at the house was first made aware is back in 2017 more than three years ago that was and no you know and that is a big issue for me right we have this is clogging up you know our agend
as this is giving you more than enough time there was work done from it from 2017 um Mr McCoy has um didn't put in the work that it it was brought into compliance then and then another this La last year another tree fell and just basically just tore the whole backside of the building down and that's what we're trying to get cleaned up now um there's three daughters um two of us live over a 100 miles away one lives in Miami where do you live up near Jacksonville you have any questions for Jones o
r the respondent uh I do go ahead Mr go uh so the original just to the respondent the original first notified as pointed out by our chairwoman uh was back in May of 2017 okay that was taken care of right and you said well obviously it's here today because it's not in compliance no another tree fell in the back and that's where it's we had a hard time getting it into compliance yeah CU it's just okay thank you we have been working on it um this like I said we live so far away it's hard to get her
e but and now since she's in I have all the paperwork from where she's in the hospital we believe that well we believe that if we can just you know get a continuance so we can continue working on it to get it done I'd like to make there's no continuance I'd like to make a motion would do a fine of $100 a day um and that way you can continue working on it and when you're in compliance and it's demolished then you can go for a lean review C 20,000 all right um Miss Roby has made a motion and Miss

he code board on July 23rd and found a non-compliance with compliance due September 2nd uh there has been no change in the status of the property and uh I have no notes that we received any contact from the owner I'm asking for a fine of $100 a day with a cap of 15 is this income property uh it's a I believe it's a rental property it's not no it's not I live there and I have I painted wait a minute okay we just need to get uh get this straightened out all right Mr Jones what can you tell us abou

ight Mr Jones um has any well it said first notified in 2018 that was 2 years ago correct and it was again then they were Ren notified again um in April of this year uh with compliance going asking for compliance by May 12th and we have not no no visible changes have been seen can I ask what kind of communication have you received from the owner I talked to Mr McCoy I don't know this guy I've been talking to Mr McCoy the off officer inspector McCoy was the previous inspector on this property uh
he is uh not with us anymore and so I was I took over this case as of uh a few weeks ago is there any like notes from him or anything I have I went through his file and did not see any correspondence uh with the owner that's a lie have you cor or have you what kind of contact that he had with the previous uh officer I was calling him and when I painted the house I called him and told him I had painted the house and I had everything cut back on the fences he said he was going to come back and loo
k I said okay I haven't I've been trying to call Miss M when was that huh when was that the end of um August of this year yes the end of August so just a few weeks ago yes because paint cost me50 bucks like I said I had a question for the inspector earlier uh is that a for sale sign it's just no that's no that's a judge Circuit Judge all right so have you Mr Jones when when did you go out look at this property when was the last time you saw this proper it would have been I believe September 2nd
it should be dated on the uh yeah we we don't sometimes we can't see that but okay but it would have been uh yeah within the last uh there you go yeah September 1st was when I was visited the property and you still maintain that it needs paint from what I could tell yes um it looks like someone had painted some of the body of the building but had just not done it finished off painting so it's not finished not finished okay okay and you can see I don't know if the photos show you there's intersec
tion of the fence it's knocked over um right and I'm waiting I got a guy coming to give me an estimate on repairing the fence okay but again I only get $700 a month so I have to do things monthly okay can all right any does anybody on the board want to have a discussion what what your thought well and since we're in the the fine stage now since we can't do anything else but do our fine I'd like to make a motion that we fine her $25 a day um so she can get the work done and we move on to the proc
eedings that we I'll second that from there I'll second that going to cap it cap it at whatever the residential $10,000,000 so we can discuss the motion now right yep go ahead can when would this start can we push the date the find start no what we can do is amend our previous order if if we don't want to find today we can amend our previous order and she can come back another month and we can decide give her another month or we can ask for anything else that we want to ask for we we don't have
to find today cuz since since the extra uh well since Mr mcco isn't around of inspectors and stuff I would like to give her more time to get together with Mr Jones and come up with a see if we can come up with a plan well I would like to note that it says first notified 1128 2018 so uh Mr Jones says he got the file he looked at it he found what he found and he took it over did his job so I think we have to have confidence in our inspectors as to what they find and what they bring to us can I say
something yes ma'am in 2018 when I contact Mr McCoy when I was serve these papers Mr McCoy said all he wanted at that time was the car the extra car that was parked in my yard that was not moving that was not a um working vehicle all he really wanted at that time was that car removed and at that time one of the windows in the front now that's what Mr and that's what I did okay then another case came up in April the rest of this case came up in April ail is that correct yes okay and at that time

ou in compliance I okay yes ma'am okay thank you all right case number four CB 0620 d142 Leist bevans anybody here no okay Mr Jones what can you tell us yes this is a a case for um violation of Land Development code with a vacant structure weeds rodent harboring protective treatment roof drainage and a uh fence um this property was posted on February 4th 2019 its compliance date was March 5th 2019 uh this was before the board on July 23rd and found in non compliance um with compliance due on Sep
tember 2nd uh the staff is requesting a fine of $100 a day with a cap of 15 I have a question for the inspector yes sir um has there been any contact with the owners I have not found any records of any contact in our system there is a permit for the uh roof it was issued back on April of 2019 uh it is still um it has been ex uh extended but nothing has been done in the blue Ro roof has remained since then is this one of Mr McCoy's cases also yes it is okay uh any other questions chair I'll enter
tain a motion to oppose a fine of $100 per day against the respondent effective today and continue until compliance is achieved it reaches the maximum $155,000 motion M uh Roby second second Mr Gonzalez all in favor say I sign oppose motion carries case number five CB 0 220-39 responded okay no no one's here Neil and cor Hitchman this case was opened for not having a uh rental license back in December of 2019 uh the property did fail an inspection on July 17th uh there's four units uh there was
some smoke detectors Windows some wood rot and paint um I have talked with the property manager we're getting we're finishing it up she said so I can have an inspection um I'd like to ask for an amended order of compliance with compliance next cut off uh question so but this case was before us before many months yes yeah and so they're still asking for more time well we finally got a rental inspection on July 17th and in reality they had 30 days to get it corrected um I I've contacted the proper
ty manager uh went over the violations of what needed to be corrected and I talked with her just as late is yesterday and we're hoping to get the inspection reinspection done why is she not here I don't know I recommended that she be here so this so This Propet is being managed yes it is but you're recommended that we don't issue the fine and just let her basically have another 30 days is that what you're that is my recommendation yes but you're pretty confidence going to pass when you go this t
ime yes okay Mak procedurally sometime the that we know that some of these cases are older um but what happens a lot of times when we get to this point that's when we start to get traction when we get that traction that's when timelines are easier to to establish so if the inspector is testifying that he thinks it can be done in the next 30 days it honestly at this point probably can cuz somebody's actually engaged in solving the problem at this point previously there was really no engagement ye
ah is this property manager have an office and does a they have an office but it's in Orlando and I right now can't recall uh the name of the company but it is a regular company uh my observation is that not being here is consistent with the attitude of prolonging I I didn't understand what you I said that my observation is by them not showing up knowing that we're at a serious stage is consistent with the attitude of prolonging give me more time it's only cut off next cut off is 9:30 it's not t
hat many days so I think I think it's okay you like to anybody like to make a motion I'll make motion to amend the previous or of non-compliance allow respondent until 9:30 to come into compliance to be returned to a subsequent meeting for consideration of fing up to $1,000 per day yes ma'am M Roby made the motion is there a second second miss heimes all in favor say I I like sign opposed no oppos two need two adopted motion carries case number six CB oh before we go on I mean we are being we're
trying to move these old cases out of here and um but the only explanation that I can give for not finding this last one is that Mr Jones says it'll be done whereas the other cases weren't so yeah and I and just to clarify what I said when I said that they that he believes it'll be done it's really like now that they're engaged we have to give them an opportunity to see if they're going to fulfill they're gonna doess I mean they've had plenty of opportunity but okay let's go on to case number s
ix c07 one more statement go ahead we're getting the assurances from the property manager not the owner right I you know that that to me is a real problem with property managers here well we'll see next month so if doesn't then we won't give them the benefit next time right yeah and hopefully it we won't be bringing this case back to you next month okay all right case number six C be 0720 106 not here rosn Paige no show do we have any contact yes I have had contact this is a unusual case uh it d
oesn't have a rental license uh they've applied for the rental license there was a uh issue in regards to a lean that was filed for some demolition of some of the property some of the buildings on the property and we're waiting on zoning to approve the rental application uh they have taken it I guess it's gone before the city management uh City manager's office uh I'm told that approval is forthcoming but at this time I don't have enough information uh to recommend doing anything but amending to
the next uh cut off okay what what kind of property is this it's a rental property it has I believe three units three or four units but when you look back through pictometry back in 2013 2014 there was additional units on the opposite side of these it's now just a u parking lot uh that was demolished uh and there is a uh a lean against the property for uh getting payment repayment for that demolition work that was done so they can't get a rental license until the the zoning and the city signs o
ff on it and until they do that then I can't do a rental inspection okay what says they were first one once again first notified about something in 2017 what can what was that the the um back uh there were some it was a complaint from a uh tenant for some Plumbing issues when reviewing the case uh realized they didn't have a rental license either uh this is just one of these cases that uh we're trying to get cleaned up so as long as they keep not paying the fine they can keep renting this proper

the engineer yet regarding the flood uh and the raising of the building uh we have filed a charges uh against the person who has taken our money and uh detective hon is in charge of that and now we have a case number I have spoken to the surveyor I have a copy of the survey I have spoken to uh Mr Meyers I think he did the floor plan uh for the work and I am hoping that within the next 60 days we can start making some progress I went to search with about regarding permits yesterday and uh what I
needed to find out was just how much work we had to do within the parameter of the amount of money that we were able to recover in order to just get us started and that's doing the exterior completely doing our plumbing our electrical and uh putting up the bathrooms men's and women's bathrooms and uh um hopefully our members are very industrious they may be able to do any of the walls and the painting but uh our members are very motivated to get our post back okay so you want to do this and now
you're saying you have funds to do this yes uh looks like it's going to be a lot of work and a project so I know that you'll need more time to do this to get permits and to do everything but I think we're I would like to see some progress reports to make sure that all this is happening okay uh because the building is in yes it it's just kind of hard to look at yes yes I I agree that we should extend do you have minutes of all of these activities that have been taking place I have some reports a

address of 701 Butler historically there's been parking issues on the property can I have photo 2013 please um and you know the issues have continued on this property photo 2015 please and 2016 please so on March 7 of this year uh during bike week I was detailed with a partner to patrol the areas where parking issues have occurred or were likely to occur on beach side uh this of course included 701 Butler uh photos CB 1 and two please which again was found in non-compliance I sent out a uh noti
ce of violation uh which the property owner uh who's in new New Hampshire by the way uh it's a a couple of gentlemen uh received on they received it on March 17 uh Mr ricot did call me on that day and said that he was in compliance I visited the property and I did confirm that photo CB three please so it was clear on that day and it has M and it has been clean okay uh since that time uh on August 24 it was determined basically because of the history of this property uh that the city should seek
um a uh non-compliance compliance on this okay um so on August 24 I posted the uh property that's the uh photo posting please um little history as ear I've had contact with the owner as early as August 13th uh he received I received a voicemail um stating that you know the the property will maintained clear uh and they contracted with a tow company to post the property that violators will be towed and they've mentioned that to me a couple of times already including this morning and I've been out
there and when was out there this morning and it's never been posted there is no toe notice there okay so we're asking for a will F find basically what Mr uh well can I ask a question well go ahead yeah uh to your knowledge was he collecting rent or someone collecting rent in his name during Bike Week there there not not not this year to my knowledge in the past uh there was a sign out there at one point I think it was in 2015 where there was an a sign that said 24-hour trailer parking and a ph
one number it was not the phone numbers that I'm aware of for these gentlemen and it was never permitted by the city for no sir okay right and John what would you like go ahead I'm sorry the other part I would just like to add is that this is an ongoing and reoccurring problem on the beach side and what happens is like you said uh it's often sometimes not even the the owner of the property that's charging it's somebody who's taken upon themselves to exploit people and charge them for their rent

hone calls over 5 years the cops would come the code would come and the problem they all said was that if they get fined or if they get noticed by the time it comes before the code board the event is over and they generally Park about 10 times a year Bike Week bober Fest uh Memorial Day Labor Day graduations all of those things they pay to park M well they tore down the house it's now Jimmy John's parking lot that's why there's been no problem this year but uh they don't maintain the property so
whatever you can do and I understand that the gentleman actually knows and I've spoken to him on the property he knew that was going on he knew the guy was doing it and he lied to the cops and said that he had a permit and I absolutely know that you cannot park in the CRA on the grass okay so um so what we can do is issue a will fine uh if you notice people parking there before code enforcement notices people parking there if you could take a picture or call code enforcement instantly so they c
an get out there and we can prove occur they can prove occurrences somehow that's probably the best way to do it but at this point code is closed when the infractions like Saturday night there were trucks park there and the Saturday night before AR aren't you out the events yes there were people out for out you may not be able to get them on the phone but they're out get on the phone yeah but I um but on the events like for the um concerts the vanill they will park there okay and any event that

d and she was required to demolish the property she actually borrowed money to demolish what she had she cleaned it up uh everything is up to par and has been for quite some time she came for a lean reduction because she's trying to rebuild a home on the property and I think the recommendation had been to zero but the conclusion by the board was to leave the lean at 5,000 and she had by March of this year I believe it was to pay that she was unable to pay it and given that the fine of 10,000 was
restored now uh her Banker actually contacted the city they are ready to finance her construction of the new home but that $5,000 $10,000 lean now is still in the way and the request that we would like you to consider is to zero that lean out with a condition that construction or the loan for the home is in place within 120 days so that she can build and if that doesn't occur it would simply be restored did you close the case Jim or you want to bring a new case this this is a case where there's
