He’s actually gone and done it… well, kind of. Felpie Massa seemed to disappear from the news towards the back end of last year and subsequently was forgotten for whatever the drama de jour was at the time. With everything thats happened since it feels like it has been a lifetime since we last received any updates about the aggrieved ex-ferrari driver. Much to our surprise then, as we opened up our laptops on Monday night for a session of “How long can I stand F1 manager before I cry myself to s
leep”, we see that Massa has enacted legal proceedings against 3 different parties. However this only seems to be the first step to Massa getting his championship, or perhaps it could be that mere recognition that he was the rightful winner is enough, as there are some pretty key phrases in the statement put out by Massa’s team that indicate that either he is happy to settle for less, or that this is just the beginning of what could be a series of subsequent lawsuits built off the back of one an
other. For the time being though, getting this first one across the line could be make or break for Felipe Massa. Want to know why this could just be the beginning? There’s some pretty interesting wording in the announcement and we think that this could go far deeper than we originally thought. Felpie Massa has now filed a lawsuit in the UK high court relating to what he believes is his missing 2008 title. Before we get into the legal proceedings, let’s just have a quick recap for those that ar
en't up to speed. In 2008 Felipe Massa lost out by a single point to Lewis Hamilton as he claimed his first title at Massa’s home race in Brazil. In any other season the “is that glock?” Moment would probably be the most memorable moment of the season as the team in the Ferrari garage went from rapturous celebration to an absolute pit of despair. However, the season went down in history for far more controversial reasons, as 3 rounds earlier in Singapore one of the most scandalous cheating and r
ace-fixing actions by anyone in the sports history took place. Crashgate allowed Fernando Alonso to capitalise on other cars having to take the opportunity to refuel after his teammate, Nelson Piquet (no not that one), was instructed to crash at turn 17. The compromised many drivers’ race, but none more so than Felipe Massa, who finished down in P13 and most importantly his title rival, Lewis Hamilton, went on to finish P3, adding 6 points to his championship tally which would become more than t
he difference between Massa winning the Championship at his home circuit in Brazil or not. It was only discovered after Nelson Piquet (no not that one) was fired from the team in 2009 that the race-fixing incident had actually happened. There was speculation and a feeling that something wasnt right, but getting it directly from the horses mouth was stunning nonetheless. Ever since Massa has insisted that the title should rightfully have gone to him, however there seemed to be a lack of direction
with his fury. That was however until March 1st 2023, where HMRC darling Bernie Ecclestone dropped an absolute bombshell: ““Max Mosley and I were informed during the 2008 season what had happened in the race in Singapore,” “Piquet Junior had told his father Nelson that he had been asked by the team to drive into the wall at a certain point in order to trigger a Safety Car phase and such to help his team-mate Alonso. “Piquet Junior was worried about his contract extension, so he was under a lot
of pressure and agreed. “We decided not to do anything for now. We wanted to protect the sport and save it from a huge scandal. That’s why I used angelic tongues to persuade my former driver Nelson Piquet to keep calm for the time being.” Before the summer break last year Massa made his intentions clear, he was going to fight to get his title and looked to anyone who could help, whether through building an all-star lawyer team or requesting his team at the time, Ferrari, fight for his, as well a
s their, World Cdrivers Championship title. Instead, Ferrari signed the man who won the title that year instead. Yikes. Massa issued a notice last year to both the heads of the FIA and FOM, detailing his legal challenge and establishing he believed he was a victim of a conspiracy at the hands of the organisations. To this, both basically left him on read and Massa’s team gave a deadline of November 15th to reply. 4 months after that deadline came and went with no substantial action on the part o
f FOM and the FIA, Felipe Massa’s team issued this statement: ““Mr. Massa is seeking declarations that the FIA breached its regulations by failing to promptly investigate Nelson Piquet Junior’s crash at the 2008 Singapore Grand Prix, and that had it acted properly, Mr. Massa would have won the Drivers’ Championship that year,” “Mr. Massa also seeks damages for the significant financial loss he has suffered due to the FIA’s failure, in which Mr. Ecclestone and FOM were also complicit. So, somethi
ng really important about all of this is that Massa is not explicitly requesting that he gains the title, merely the recognition that had all things gone as they should have done then he would have been the winner of the 2008 title. This massively leaves the door open for one of two things. Either Massa to close it, go off into the sunset with his money and the knowledge that the public now know who should have won the title, or more likely for Massa to initiate a second phase of legal proceedin
gs off the back of this first lawsuit, with it being confirmed that he is the rightful holder in spirit and theory, he can then push to claim it in reality. However this would then open up a whole other can of worms. You may be wondering “why would he just settle with it being known and not actually push for it” and it’s one simple argument. You change the result of the race, then every race that follows with it’s jeopardies and pressures being different also changes. The future events that foll
owed Singapore in Japan, China and Brazil may well have gone in a completely different direction. However, Massa’s argument will likely be that all of this should have changed the moment that Ecclestone and Mosely were informed of the wrongdoing and that they should have taken the action that Eccleston suggested they would have done, something highlighted in the statement, as it continued: “As Mr. Ecclestone has admitted, there was “enough information in time to investigate the matter” in 2008 a
nd “cancel the race in Singapore“. Mr. Ecclestone further affirmed that, had the results of the 2008 Singapore Grand Prix been canceled, “Felipe Massa would have become world champion” and that Mr. Massa “was cheated out of the title he deserved. ““Attempts to find an amicable resolution have been unsuccessful, leaving Mr. Massa with no choice but to initiate legal proceedings. “Recent events naturally demonstrate that issues of transparency and integrity in Formula One remain relevant, and it i
s clear that serious work is needed to restore its credibility and long-term future. “Although the FIA investigation in 2009 concluded that it had “never before considered charges as serious”, even after the revelations brought forward last year, the results of the 2008 Singapore Grand Prix still stand and remain officially sanctioned by the FIA.” So with that being the case, Massa and his team may not even need to file subsequent lawsuits to secure the championship, as if Singapore 2008 no long
er remains a sanctioned event, then all points from that race will be nullified and the classification at the end of the season will be changed, leading to Hamilton dropping 6 points. This would mean that Massa would win the World Drivers Championship by 5 points (the equivalent of a 4th place finish back in those days). Eccleston, despite being one of the members directly targeted by the lawsuit claims that he backs Massa’s decision, however did it in a typically Bernie fashion, as he said: ““I
f he had asked me, I would have said it was the complete right thing to do, to sue, and to let an English judge decide what is right and wrong. “I cannot say anything about the outcome and what will happen. From his point of view, it is better that an English judge comes up with a verdict. It will be of more help for him.” Meanwhile both the FOM and FIA at the time of writing have declined to comment on the situation, however they can’t simply ignore it and hope it goes away anymore. Given that
their apathy likely came from “it wasn’t us, it was a different time” is not something that will hold up in court, as the two parties could have decided at any time to take Massa’s complaints seriously and dealt with them either way. Due to their inaction, it’s now been escalated to what could be a very public embarrassment for all 3 defending parties, and certainly in the case of the FIA not even their first embarrassment this week, given that they are under heightened scrutiny following the he
ad of the FIA and walking punchline, Muhammed Ben Sulayem is currently being accused of attempting to intervene with a race result himself ironically, as well as attempting to get the poster child of Liberty Media and F1, the Las Vegas grand prix cancelled. Whether or not he is still at the helm by the time this actually gets to court is a matter for another video, but for the time being you’re as up to date as we are on this situation. Thats a tough one. I can see it from Massa's point of view but Hamilton had nothing to do with crashgate. After all this time I think you have to let it stand.

He's right but it is impossible to replay the rest of the season and how each team would have responded to a different situation than what they were in at the time. Infinite decisions were made considering their relevant positions in the championship, most of those would have been different given the standings were different. It's a vast oversimplification of how sports are played. It would be like giving a match win to the other team because there were 2 bad calls that cost them goals in the first period and they only lost the match by 1. Utter nonsense.

Isnt there a statute of limitation on this? 7 years ? Its a long time ago. Maybe the England football team can sue the Argentinian team for the Hand Of God.

If this case does happen and the SG gets dropped, changing titles, technically there would be a precedent for AD21. But if we drop that result, Max still keeps the WDC from having more wins. But it was neither drivers fault, it was race control. LH already came out and said if the tables were turned he would have done the same thing. You must always go for it.

Another fact about this case is that that 2008 McLaren shouldn’t even have been on the grid. Max Moseley was about to ban the team for 1 year after spygate (2007), but again, Bernie intervened. 🤦🏽‍♂️

As obsereved by the inconsistencies by the stewards in the last race in Saudi Arabia, This FIA bs is still going on. F1 has lost its credibility as far as I'm concerned.
