much Tom dpri former deputy Assistant Attorney General in Focus now so we look back at yesterday uh what did America learn from all of that I mean a lot of it was show boting um particularly by democrats who thought that they just could not sit with how much was in that report about the president's memory or lack thereof there was no shortage of showboating yesterday Harris and as to what America learned from it I'm not sure they learned very much I think one thing they learned or at least confi
rmed is that president Biden was not exonerated by the special counsel to me that was one of the most striking aspects of what unfolded yesterday is we saw a Democrat after Democrat pushing hard on the special counsel to say that President Biden was innocent that he had exonerated President Biden and the special Council held his ground I lost track of how many times he had to clarify the word exonerated is not in my report and that was not my conclus so real quickly what's the difference between
not charging a man because you say his memory is bad and and even though there were tapes apparently audio tapes of a ghost riter that threw out Biden's saying that he had this classified information and had shared it we know with the ghost writer like with all of that evidence still Robert Hur saying no no no no evidence what's the difference between that and exoneration right well prosecutors don't exonerate people what happened here is that Robert herd declined to bring charges or recommend
charges and really the difference is that it's not a finding that President Biden didn't break the law or that he did nothing wrong to the contrary the special counsel I think was pretty clear that President Biden did wrongfully take classified documents with him instead what the special counsel said was that despite this evidence that you could use to prove that he committ Brien committed a crime the special counsel didn't think a prosecution was warranted probably because he thought he could n
ever obtain a conviction given that President Biden is older and and would come across to a jury as forgetful well and he said that was precisely the reason that he added that detail about the president's lack of memory all right less than one hour ago the judge overseeing the Georgia election interference case against former president Donald Trump dismissed six of the charges in the indictment including three against Trump but it does leave intact many other charges in the indictment and the ju
dge wrote that prosecutors could seek a new indictment on the charges he dismissed the six charges in question have to do with soliciting elected officials to violate their Oaths of office and that includes Trump's phone call to Georgia's Secretary of State asking him to find about 11,000 votes what's your take on the dropped charges against Trump and others in this in this case my take is it's a win for former president Trump and the other defendants it's not a total win because of course there
are a lot of charges that still remain but he did dismiss a bunch of charges against Trump and the other defendants and the reason the judge did for doing so Harris was very interesting he basically said the prosecutors just hadn't alleged the facts that would show a crime was committed in connection with those charges and he said that in order to be able to defend yourself in court and exercise your constitutional rights you have to know the facts that they're charging you with in order to be
able to defend yourself and in the judge's view the prosecutors just hadn't provided the facts all right we'll watch for the other counts and see what happens in this case as you say a win for Trump and the other defendants Hunter Biden has just declined to attend a public Congressional hearing this happened just a few minutes ago breaking news it was supposed to happen next Wednesday and it's on influence pedaling it's part of House Republicans impeachment inquiry into his father President Bide
n Hunter Biden's attorney says it's due to a scheduling conflict but we know they've repeatedly been asking for a public hearing Hunter's former business associates Tommy balinsky and Devon Archer were also invited to attend what do you make of all this I mean he had that big stunt where he showed up on Capitol Hill unannounced and wanted all that public attention and all the all the things and now they back away yeah Harris the old scheduling conflict is one of the oldest tricks in the book and
look I think it's pretty clear that Hunter Biden's lawyers are playing games here as you point out he's been doing all sorts of shenanigans showing up at Congress waving not testifying insisting he wanted a public hearing and then when he's offered the public hearing he turns it down this doesn't surprise me at all I think that his lawyers are basically trying to kick the can down the road and really avoid any further opportunity to have their client appear before Congress and the American peop
le and tell the truth all right well one of the reasons and I had said this during the breaking news coverage that we did off the top uh this hour was that they had another case that they had to a criminal case that they have to focus on what do we know about the other cases against Hunter Biden at this point right well he's facing Jeopardy on multiple fronts right now Harris and you know I think that there probably is some truth that he will have scheduling conflicts in the weeks ahead the case
that he inv uh for the scheduling conflict here involves his tax matter that's pending out in California I think that the hearing that Congress Trump wanted to get him to testify out was the day before he has to be in California for that case so there may be some legitimacy that he does have a conflict around that time but look there's no question that he can work in and around his various other criminal matters pending to find time to come to Washington and tell the American people in the Cong

Why is Congress "offering" or "inviting" Hunter to come to these hearings? Subpoena him and if he doesn't show or shows up and leaves charge him with Contempt of Congress and toss him in jail.
