sports betting is legal and March Madness is underway it is the perfect recipe for some betters to put some money on their favorite team but could those possible winnings be off for not a FanDuel user in Louisiana is claiming their winnings on the gambling platform were intercepted to pay for child support debt now those claims include an email from FanDuel informing the person that the Louisiana Department of Children and Family Services child support enforcement division had notified them of a
n open child support debt all right so let's go ahead and bring in Chief legal analyst colie froess to this conversation so how exactly does this work this is a very very weird thing let me start with this when I saw the snippet online I was like wow that's crazy like I didn't know that was even a law and so I love when I can find out something new and today was one of those days and this is probably more for the casinos right but I found a site that lists all of the rules in in in every state t
hat has a rule that can do this drawback or this catch back to your winning and Louisiana is one of them and it basically m stes that if you are a lensey you have to check this database and so first it requires that the state has a database and they have to update it in real time and give you access to it and so if you're a lensey a casino or gaming person that has a license to take Wagers in the state you have to check before you send out a Wagers payout this database and also you have to check
on there the show and list that it you found no result I thought that was so crazy that I have to go on there and show it and I have to attach to the file that this person return turned back no result once it's done they it's the the statute says that they can deduct their $35 Finance fee and then they can take whatever amount that person owes then they can pay the person's winnings out and so if like in this individual situation you had past du child support in the careers then it it swallows
up all of your winnings and so a day that looks great on a parlay turns into a no payout for you and maybe a good day for your kids or maybe it could have been a good way to get get to pay that child support in some ways I mean but the problem with this whole thing is that there I've seen push back on both sides like wow how could they take this individual's money but on the other side you got the mother that's been going to court trying to figure out why haven't you paid this child support for
the last two three four five years exactly the other thing too is that can they go in and get some other things too if they find out if there's a warrant or find out if they owe T Pack taxes or something like that so there are there are a number of different Avenues out there to find that but this one this statute specifically addresses the the amounts of money that are owed for this and this is from push for lobbyists for for mothers specifically I mean because this is a two-way street but the
overwhelming majority of individuals that are failing to pay their child support is the mail and so these are groups of mothers out there trying to figure out how they can get some recourse and if you have the unlimited resources or disposable funds that's spending on gaming they're saying we're going to go after it and get it North Carolina has the same thing I saw statues in North Carolina that addressed lottery winnings I didn't see anything for gaming but I did see lottery winnings so if you
have a lottery ticket and you go out there and try to cash it in and you have back child support they can get access to that between 2017 and 2021 North Carolina withdrew $500,000 from other individuals winnings to pay child support so these agencies are out there trying to get access to funds that maybe you shouldn't have access to anyway all right collie thanks we learn something new every day so uh keep that in mind all of us [Music] Terra
